How is it legal to sell concert tickets above original price?

I am trying to find tickets for a concert that went on sale two days ago for a show in about 3 months. All that is left from the venue are really crappy seats. Sights like eBay, Stubhub, and Ticketmaster’s ticketexchange are selling dozens of tickets with the cheapest being about 4 times the original price, and going up to 10 times the price. This isn’t legal outside the venue, why is it legal online?

Most legal firms are very particular about the quality of legal support staff they engage – people like the paralegals who complement the works of the lawyers, receptionists who welcome the clients and secretaries who type the various legal documents as they become necessary. The law firms realize that the quality and success of their practice might ultimately depend on the people they engage in these capacities – than on anything else. And based on this understanding, many legal firm administrators are willing to go to almost any lengths to ensure that they get the right people for these jobs. It is therefore not surprising that the lawyers and other legal firm administrators are always on the lookout for any forum through which they can gain access to the very best staff for their operations – and the latest such forum is the Internet.

As it turns out, more and more legal firms are posting their legal support jobs online – and the Internet is indeed the place to find a job if you are, for instance, a legal secretary, a paralegal professional or a legal receptionist.

Most legal firms post their vacancies on the public online job forums – because with the exception of the very top legal firms, most are relatively smaller operations and their websites don’t get that many visitors. In any case, the nature of the legal business is that it can only deal with so many clients at a time- and therefore it might not even be desirable for them to want to attract the masses.

Take note however, that many online job forums may not have specific sections for jobs in legal support. Instead the jobs could be found in various other sections – like for instance, under the section for receptionist jobs. Even if a particular online job notice has a specific section for such jobs in legal support, there is still a chance that a law firm (in a bid to reach the widest possible audience) could post its vacancy for a receptionist under the section on receptionist jobs – rather than on the section for jobs in legal support. In the case where the law firm is looking for a person proficient in a particular language, they could post in the section for ‘language jobs.’ Thus if for instance an international law firm with clients in France is looking for a legal secretary who is proficient in French, they might post the job in the section for language jobs on the online job notice board– rather than on the sections for jobs in legal support or secretarial jobs you would otherwise expect such a job to be posted. The moral here is that it pays to widen your search.

Needless to say, you need to ensure that you are dealing with a credible online job notice board, as a few could be hoaxes. In most other professions, people are advised to look at the websites of the firms they want to work with for vacancies but as noted earlier, the online job forums might be the best places to check for jobs in legal support. It is worth noting, however, that the more prominent law firms do indeed tend to have a ‘careers’ section on their websites, and this is also one of the places you can check for the jobs in legal support. But then again, competition for jobs in legal support in these prominent legal firms tends to be rather stiff and their standards and expectations can be what many people consider a bit too high for them – though on the other side, their salaries and benefits tend to be commensurate.

Causes and Types of Legal Malpractice

Legal malpractice traditionally has been characterized as an action for professional negligence against an attorney by a former client claiming that the attorney has failed to use such skill, prudence, and diligence as lawyers of ordinary skill and capacity commonly possess and exercise in the performance of the task or task which they undertake. When an attorney acts in a negligent manner or fails to exercise reasonable care when providing legal advice or representation, it is legal malpractice. The laws on legal malpractice vary from state to state. When a client visit an attorney for advice or representation, the attorneys owes certain duties to the client. The attorney owes a primary duty of reasonable care. The duty that a lawyer owes a client has two components–competency and protecting the fiduciary relationship with the client. An attorney owes his client undivided loyalty and confidentiality. An attorney can be liable for legal malpractice if the attorney breaches his fiduciary duty through self dealing, conflicts of interest, disclosure of client confidential information and disclosure of former client confidential information. Failure to exercise reasonable care can result in legal negligence. Reasonable care means the care other attorneys in the same field and community would exercise under similar circumstances. In general, an attorney owes a duty of care to a person once that person hires the attorney and becomes a client. Any conduct of the attorney which deviates from the conduct of other attorneys under similar circumstances and causes loss to the client amounts to legal malpractice. The following may amount to legal malpractice: a case is dismissed because the attorney failed to properly pursue the case; the attorney failed to secure witnesses and experts for the case; the attorney failed to act before a statute of limitations or calendar deadline; the attorney forced settlement in a case for any reason that unjustly harmed the client; and any other failures or errors that result in client damages. For legal malpractice to occur there must be an attorney-client relationship. There should be negligence on the part of the attorney in the legal representation of the client and the negligence must be a proximate cause of loss suffered by the client. The loss must be from the attorney’s misconduct. Also the client must suffer actual damages as a result of the legal malpractice. A victim of legal malpractice can claim compensation for the loss suffered. In some cases, the victims may be entitled to punitive damages. In certain situations, triple damages under state consumer protection statutes may also be available. The victim can also claim damages for mental anguish or suffering. In most cases of legal malpractice, the attorney may rely on what were formerly privileged communications from the client in order to respond to allegations of negligence. The attorney will not be liable for what, in hindsight, were errors in judgment where the attorney made those judgments in good faith and in the honest belief that the decisions were well founded in the law and made in the best interest of the client. This is known as attorney judgment rule. Since damages are not presumed in a legal malpractice case, the victim bears the burden of proving actual damages as a result of the attorney’s negligence.

The Los Angeles Daily Journal announced in their March 19 issue that pay scales for first-year attorneys rose yet again, with a number of firms hitting a staggering $160,000 starting salary. In the UK, the situation is much the same. The Lawyer.com reported that Linklaters is expected to heat up the pay war with an increase in its associate salaries of around 16 percent, to £69,000. The expected hike would push Linklaters ahead of Clifford Chance in the battle to win over top-flight graduates with lucrative starting salaries. Unsurprisingly, the remaining “magic circle” firms are currently “reviewing their salaries”.

Is it just me or does anyone else have a sense of “keeping up with the Joneses” going on here? Why do firms feel such enormous pressure to match each other in junior associate pay? The reason is because they are all trying to compete for the same pool of top talent. The competition for available talent is only going to become even more intense as 75 million baby boomers will soon give way to around 30 million generation X-ers. Although its seems incredulous right now given the preponderance of law school graduates, various studies indicate that there will be a shortage of around 14 million skilled workers in the US by 2020.

How high can the salaries rise and how long can this go on for before the tide turns? The answers lie with the leading firms’ corporate clients. Although there is no present indication that these clients aren’t willing to pay premium bills for multi-million dollar litigation matters, eyebrows are starting to be raised at first year associates’ over inflated hourly rates for routine, transaction based legal work.

The top law firms are perfectly aware of this and realize that while they will continue on the one hand to pay the ever decreasing pool of US and UK skilled talent ever increasing wages, they are also on the look out for cheaper labor elsewhere. This labor has become available through the opening up of the global legal marketplace and the increasing proliferation of offshore and outsourced legal process support companies. The major law firms on both sides of the Atlantic are now looking towards Asia, and in particular India, to provide them with the extra string to their bow that their clients are beginning to demand.

Think about this: we’re not far from the day where the top firms will be paying their newly qualified associates salaries approaching $200,000 per annum. Do these firms and their clients really want these associates’ time spent on document review and routine transaction based tasks if this work can be done elsewhere? If the US and UK talent pool is shrinking, these associates will increasingly be spending their time on higher-end legal work both out of necessity and because their clients will simply not accept anything else. India’s vast pool of highly qualified legal talent is the obvious choice to provide the outsourced legal support the US and UK firms will require. It is this thirst for talent that has led to the development of the Offshore Legal Process Outsourcing industry. US and UK Law firms have been exploring and developing relationships with offshore legal service providers now for the last 12-24 months and this trend shows no signs of slowing down. Offshore legal process companies such as LawScribe have moved beyond traditional back office legal support services to increasingly more complex core legal work including legal research, patent and trademark searching and drafting, document drafting and due diligence.

It’s also no secret that over the last 12 months a number of the top 100 firms have sent high power delegations to India. Some UK Government sources predict a partial opening of the Indian legal services market within a couple of years. The 1961 Advocates Act, which forbids foreigners from practicing in India, will also have to be amended.

Until these changes are implemented even the largest firms will continue to explore relationships within the growing legal process outsourcing market. So long as associates’ salaries continue to rise and clients increasingly become more demanding and price sensitive, the offshore legal process outsourcing industry will continue to flourish.
